Oregon Medigap Birthday Rule: Switch Medicare Supplement Plans Penalty-Free

Oregon Medicare Supplement policyholders have an annual guaranteed window to switch Medigap plans without medical Underwriting. The Oregon Medigap Birthday Rule gives you the right to change carriers or plans once a year, no health questions, no risk of denial.

What Is the Oregon Medigap Birthday Rule?

Oregon’s window runs 31 days before your birthday through 31 days after your birthday, a total of 62 days. During this window, insurance carriers cannot ask health questions, require a medical exam, deny your application based on health status, or charge more because of a Pre-existing condition.

Who Qualifies?

  • Must be an Oregon resident
  • Must currently be enrolled in a Medigap plan
  • Must apply within the birthday window (31 days before through 31 days after your birthday)

You may switch to a Medigap plan with equal or lesser benefits than your current plan.

The most common use: switching to the same plan letter with a cheaper carrier. Medigap plan benefits are federally standardized, every Plan G in Oregon covers exactly the same things. Only the Premium differs.

How Much Can You Save?

After a few years of rate increases, another carrier may offer the same Plan G for $40 to $80 less per month, $480 to $960 in annual savings for identical coverage. The savings potential grows with age as premium gaps between carriers widen.

How to Use Oregon’s Birthday Rule

Step 1: Count 31 days before your birthday and 31 days after, that is your window. Example: birthday October 10, window is September 9 through November 10.

Step 2: Compare Medigap rates in Oregon from multiple carriers for your current plan letter.

Step 3: Apply during your window. No health questions will be asked.

Step 4: Wait for written confirmation with an effective date before canceling your current plan.

Does this apply to Medicare Advantage? No. Medigap plans only.

Can I upgrade to a richer plan? No. Equal or lesser benefits only. You cannot use the Birthday Rule to go from Plan N to Plan G.

What if I am in poor health? Carriers cannot deny you or charge extra due to health during the window. That is the purpose of Guaranteed issue.

What if I miss the window? Wait for next year’s birthday window, or check whether a qualifying life event gives you guaranteed issue rights in the meantime.
